1. Who we are

This website, cabellototal.es ("CabelloTotal", "we", "us"), is operated by Pro Pelo Y Belleza S.L., a Spanish limited company with its registered address at Calle de Herreros, 28939 Arroyomolinos, Madrid, Spain. You can contact us at any time by email at orders@viahairbeauty.com.

2. Scope of these Terms

These Terms and Conditions govern the online sale of professional haircare, hair colour, styling, tanning and body care products through cabellototal.es to consumers in Spain and Portugal. By placing an order, you confirm that you are at least 18 years old, that you are purchasing as a consumer, and that you accept these Terms. Nothing in these Terms affects your statutory rights as a consumer under EU, Spanish or Portuguese law.

3. Ordering and contract formation

Placing an order through our website constitutes an offer to buy the products in your basket. The steps are:

• Add products to your basket and proceed to checkout.
• Enter your delivery and payment details and review your order before confirming it.
• After you submit your order, you will receive an order acknowledgement by email. This confirms we have received your order but does not yet constitute acceptance.
• A contract is formed only when we accept your order, which happens when we send you an order confirmation or dispatch the products (whichever comes first).

We may decline an order, for example where a product is unavailable, where we cannot verify payment, or where an obvious error has occurred. If we cannot accept your order, we will inform you and refund any amount already paid.

4. Prices and payment

• All prices are shown in euros (EUR) and include VAT (IVA) at the applicable rate. Delivery costs, if any, are shown at checkout before you confirm your order.
• Payment is processed securely at checkout by Shopify Payments and the payment methods displayed there, including Visa, Mastercard, Maestro, Apple Pay and Google Pay. We do not store your full payment card details.
• Despite our best efforts, a small number of products may occasionally be mispriced. If a pricing error is obvious and could reasonably have been recognised as such, we are entitled to cancel the order and refund any amount paid; we will contact you first where possible to ask whether you wish to proceed at the correct price.

5. Delivery

• We deliver to addresses in Spain and Portugal using courier services.
• Estimated delivery timescales are shown at checkout and are typically 2-5 working days, depending on your location. These are estimates, not guaranteed dates; if delivery is delayed significantly, please contact us.
• Delivery is free on orders over €50. For other orders, the delivery cost is shown at checkout before you pay.
• Risk in the products passes to you when you (or a person you have nominated) take physical possession of the goods.

6. Right of withdrawal (14 days)

As a consumer in the EU, you have the right to withdraw from your purchase without giving any reason within 14 calendar days from the day you (or a third party you nominate, other than the carrier) receive the goods, in accordance with Directive 2011/83/EU and the applicable Spanish and Portuguese consumer legislation.

How to exercise it:

• Inform us of your decision to withdraw before the 14-day period expires, by an unequivocal statement sent by email to orders@viahairbeauty.com (you may use the model withdrawal form provided by EU law, but it is not obligatory). Please include your order number.
• Return the goods to us without undue delay and in any event within 14 days of telling us you wish to withdraw. The direct cost of returning the goods is borne by you.
• We will refund all payments received from you, including standard delivery charges (but not any supplement for a non-standard delivery option you chose), within 14 days of being informed of your withdrawal. We may withhold the refund until we have received the goods back or you have supplied proof of having sent them. The refund will be made using the same payment method you used, at no cost to you.
• You are liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Exceptions: the right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed. This means that cosmetic, haircare and body care products that have been opened or unsealed cannot be returned under the right of withdrawal. Unopened products in their original sealed packaging can be returned normally.

7. Statutory guarantee of conformity

All products we sell are covered by the statutory guarantee of conformity for consumer goods. If a product is faulty or does not conform to the contract, you are entitled to have it brought into conformity (repair or replacement) or, where that is not possible or proportionate, to a price reduction or refund, free of charge.

• For consumers in Spain, the guarantee period is 3 years from delivery under Royal Decree-Law 7/2021.
• For consumers in Portugal, the guarantee period is 3 years from delivery under Decree-Law 84/2021.
• EU law guarantees a minimum of 2 years in all Member States; your local rules apply in your favour.

To make a claim under the guarantee, contact us at orders@viahairbeauty.com with your order number and a description (and, where possible, photos) of the issue. This statutory guarantee is independent of, and in addition to, the 14-day right of withdrawal.

8. Product information and safe use

• We take care to describe products accurately, but images are illustrative and packaging may occasionally vary.
• Cosmetic and haircare products, in particular hair colourants and lighteners, must be used in accordance with the manufacturer's instructions printed on the packaging or leaflet.
• Where the manufacturer indicates a skin sensitivity (patch) test or strand test, always carry it out before use, and observe all warnings, including those concerning use on children, damaged skin or previous allergic reactions.
• Keep products out of the reach of children and discontinue use if irritation occurs.

9. Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, for defective products under applicable product liability law, or your rights under the statutory guarantee of conformity and any other consumer rights that cannot be excluded or limited by agreement. Subject to the above, we are not liable for losses that were not foreseeable to both parties when the contract was formed or that are not caused by our breach, nor for business losses, as we supply products for private consumer use only.

10. Governing law and dispute resolution

These Terms are governed by Spanish law. If you are a consumer resident in Portugal (or elsewhere in the EU), you also benefit from any mandatory consumer protection provisions of the law of your country of residence, which remain unaffected.

Any dispute may be brought before the courts of the consumer's domicile. If you have a complaint, please contact us first at orders@viahairbeauty.com — we will do our best to resolve it.

You may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr, and you are entitled to make use of the consumer arbitration bodies (consumer arbitration boards in Spain, and in Portugal the alternative dispute resolution entities for consumer disputes) available in your place of residence.
